Death Penalty: Unjust and Unfair
The United States sorry justice trunk is imperfect. Issues and problems ar present and evident deep down law enforcement, corrections and the judiciary. One issue and problem that transcends these trinity segments of the unlawful justice system is capital punishment. Capital punishment in the United States is not a perfect system and it is broken. Debate over use of the decease penalty has been occurring in America since colonial times (DPIC, 2010). Death is irreversible and every effort needs to be taken to ensure the termination penalty is applied justly and clean. This paper offers the argument that the death penalty is not just or applied slightly because of flaws in the judicial process, accused individuals do not turn around adequate representation and it discriminates against individuals.
Judicial Process Flaw
During a bringing at an American Bar Association gathering in 2005, United States Supreme Court Justice John capital of Minnesota Stevens told those in attendance that he was disturbed by monstrous flaws in capital punishment (Associated Press, 2005).
His concerns call into question our criminal justice system and administration of the death penalty. One of the flaws is the design of electing judge. Do elected judges act impartially and fairly or are they influenced by national opinion? Do judicial elections influence judicial behavior? There is present that elected judges may be swayed by public opinion and pressure of elections. Paul Brace and Brent Boyea hatch this in the April 2008 edition of American Journal of Political wisdom when they indicate that the impact of elections and public opinion on judges may be justified.
